Cupar 23 September 1830 … obligation as follows: I, Robert Dalgleish of Scotscraig, considering minute of agreement between me and William Berry, Tayfield, 25 November 1828, William Berry gave his assent to the line of the turnpike road between Newport and Ferryport on Craig as proposed by me on a plan prepared by Alexander Martin, surveyor in Cupar, relative to the new Turnpike Bill for … Fife, such road not to interfere with or injure the right of access to the shore held by said William Berry, & William Berry also agreed to allow me to make such part of the said road connected with his lands when I should think proper so to do, and in consideration thereof I became bound by said agreement to execute these precients [?] in favour of William Berry as under written and now seeing that said line of road has been completed in terms of the agreement, William Berry has fulfilled his part of the same, wherefore in implement of my part of the agreement I hereby bind & oblige myself, heirs & Successors, that from and after Martinmas last the house & offices connected therewith lately possessed by Thomas Honeyman at Maryton shall not be let or used as an inn nor as a posting house nor in any way connected with an inn or for the purpose of stabling or giving public accommodation thereat or for a coaching establishment, & in the event of I or my foresaids selling or disposing of said premises I do so … only under the restriction above written & to insert same into the conveyances so as to render it effectual … RS32/180/102
